Information according to § 5 TMG

Nursing Service at the Market GmbH

1. Scope

These terms and conditions apply to all contracts between Pflegedienst am Markt GmbH and its clients for outpatient care services. Any differing terms and conditions of the client are not recognized unless expressly agreed to in writing.

2. Conclusion of the contract

A care contract is concluded through a written agreement between the client (or their legal representative) and Pflegedienst am Markt GmbH. Amendments and additions must also be in writing.

3. Scope of Services

The scope of care services depends on the individual care contract and the care plan, which is drawn up together with the client or his relatives.

4. Service provision

Services are provided by qualified nursing staff. There is no entitlement to a specific caregiver, however, continuity of care is ensured. Care services are provided at the agreed time, although slight variations in timing are possible.

5. Remuneration

Billing is based on current rates and long-term care insurance benefits. Customer co-payments are contractually agreed upon. For services paid privately, invoices are due within 14 days.

6. Termination

The contract can be terminated by either party with 14 days' written notice. Termination without notice is possible in cases of serious breaches of contract.

7. Liability

Pflegedienst am Markt GmbH is liable only in cases of gross negligence or intent. No liability is assumed for property damage or personal injury caused by force majeure.

8. Data protection

The customer's personal data will be treated confidentially in accordance with the applicable data protection regulations (GDPR) and used exclusively for the fulfillment of the contract.

9. Final Provisions

Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. German law applies. The place of jurisdiction is Gelsenkirchen.
